Terms of Service

These Terms of Service ("Terms") govern your use of store.kumos.dev (the "Site") and any products or services sold by Kumo ("Kumo", "we", "us"). By using the Site or buying from us, you agree to these Terms. If you don't agree, don't use the Site.

1. What We Sell

Kumo sells two things: digital products(Claude Project Kits — structured instruction packages for use with Anthropic's Claude and similar AI tools) and professional services (web design, hosting, and web application development, scoped in individual engagement proposals).

2. Digital Product License

When you buy a Claude Project Kit, you receive a personal, non-exclusive, non-transferable license to use the files in your own work, including commercial work. You may:

  • Load the instructions into your own Claude Project or AI workspace
  • Modify and adapt them for your workflow
  • Use outputs generated with the kit in your personal or business work

You may not:

  • Resell, sublicense, or redistribute the kit files themselves
  • Package the files (in whole or substantial part) into another product for sale
  • Represent the kits as your own original work

Some kit instructions are also published openly on github.com/makaisapp/kumo-open-instructions. Openly published instructions are covered by the license stated in that repository and override the restrictions above for those specific files.

3. Services

Services are delivered under a separate written proposal that specifies scope, price, timeline, revisions, and milestones. The proposal controls if it conflicts with these Terms. All service pricing is fixed-price unless stated otherwise. Application-build engagements use a 40% / 40% / 20% milestone structure (kickoff / beta / launch).

4. Payment

Digital product payments are processed by Stripe. Prices are in USD. You are charged in full at checkout. You will receive a receipt by email. Service payments are invoiced per the engagement proposal.

5. Delivery and Access

After you complete a digital purchase, we create an account tied to your email and send you a magic-link sign-in. Your order and download links live in your account at /account. Download links are signed and time-limited; re-download any time from your account. If delivery fails, email kumo@makais.app.

6. Refunds

Digital products have a 14-day, no-questions refund window. Services are refundable per the terms in the engagement proposal. Full details: Refund Policy.

7. Third-Party Dependencies

Claude Project Kits are designed to be used with Anthropic's Claude and similar large language models. We do not control, and are not responsible for, the availability, pricing, outputs, or terms of those services. AI models can produce incorrect or inappropriate output. You are responsible for reviewing any AI output before relying on it, especially for legal, medical, financial, or safety-critical decisions.

8. Acceptable Use

You agree not to:

  • Use the Site or products for unlawful purposes
  • Attempt to break, probe, or evade security on the Site
  • Scrape, resell, or mass-export Site content without permission
  • Use our products to generate content that harasses, defames, or infringes others

9. Accounts

You are responsible for the security of your magic-link email and the activity under your account. Tell us if you suspect unauthorized access.

10. Disclaimer

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-ASSISTED OUTPUT IS NON-DETERMINISTIC AND NOT GUARANTEED.

11. Limitation of Liability

To the maximum extent permitted by law, Kumo's total liability to you for any claim arising out of or relating to the Site, products, or services is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

12. Indemnification

You will indemnify and hold Kumo harmless from claims arising out of your misuse of the Site, products, or services, or your violation of these Terms or applicable law.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Exclusive venue for any dispute is the state and federal courts located in California, and you consent to personal jurisdiction there.

14. Changes

We may update these Terms. Material changes will be posted on this page with a new "Last updated" date. Continued use after changes means you accept the updated Terms.
